
AGREEMENT FOR BYBIT PAY
1. This Agreement for Bybit Pay (“Agreement”) governs your access to and use of the Bybit Pay Services (as defined below) and related services entered into by and between you (the “User”, “you”, or “your”) and Bybit Technology Limited (the “Company”, “Bybit”, “we”, “us” or “our”). This Agreement forms a binding agreement between Bybit and you and serves to supplement our Terms of Service found at https://www.bybit.com/app/terms-service/information (the “Service Agreement”). If you do not agree to any terms or conditions of this Agreement, you must immediately cease using the Bybit Pay Services. By using the Bybit Pay Services, you agree to be legally bound by this Agreement, the Service Agreement, and all other terms and conditions and rules relating to the Bybit Pay Services (“Terms”) that we may publish from time to time, including those without prior notice to you.
2. In the event of conflict or inconsistency between a term or provision in this Agreement and the Service Agreement, such conflict or inconsistency shall be resolved by giving precedence to this Agreement. All other provisions of our Service Agreement not modified by this Agreement shall remain in full force and effect.
3. The Terms regulate your access to and use of the Bybit Pay Services (as defined below). All payment and other related services provided as part of the Bybit Pay Services and the Platform are governed by the terms and agreements between you and the respective service providers designated by us.
4. You acknowledge and fully understand the risks involved in the depositing of cryptocurrencies and unconditionally accept the potential risks and benefits of your own investment decisions. You also further understand and confirm that you have the experience and knowledge necessary to invest in non-guaranteed digital currency or asset products. In particular, you should understand the risks of the technology.
5. Our Site and Platform are not intended to provide tax, legal, insurance, or investment advice, and nothing on the Site or Platform should be construed as an offer to sell, a solicitation of an offer to buy, or a recommendation for any security or crypto asset by us. You alone are solely responsible for determining whether any investment, security strategy, or any other product or service, is appropriate or suitable for you based on your investment objectives and personal and financial situation. You should consult an attorney or tax professional regarding your specific legal or tax situation.
6. Risk Disclosure. Please note that this Risk Disclosure is in addition to any risk disclosure in relation to products traded on our Platform. Before using the Bybit Pay Services, you should carefully and duly consider your overall financial situation, including your financial commitments and planning. You understand and accept the risks that may arise from using the Bybit Pay Services and all losses, expenses, costs, damages, liabilities, penalties, charges (“Losses”) that you may suffer from using the Bybit Pay Services, including but not limited to:
6.1 Disclaimer of Platform Use. We do not assume any responsibilities or liabilities for your use or access to our Platform. We cannot and are not obligated to guarantee the outcomes of your use or access to our Platform. You agree and accept that you shall solely bear all Losses as a result of your use of our Platform, and we shall not be liable for any Losses in connection with your use or access to the services provided by Third Party Service Providers (as defined below), including without limitation, any transactions you dispute.
6.2 Fees. When you access or use the service(s) provided by the Third Party Service Providers (as defined below), the Third Party Service Providers may charge you handling fees, service fees, and/or any applicable fees. By accessing or using the Bybit Pay Services, you agree to pay all applicable fees and/or any additional fees charged by and payable to the Third Party Service Providers or Governmental Authorities.
6.3 Third Party Terms. You may be subject to terms directly between the Third Party Service Providers and you with respect to your use or access of the services provided by the Third Party Providers (“Third Party Terms”). Any such Third Party Terms are solely between you and the Third Party Service Providers. We are not a party to any such Third Party Terms, and we disclaim any and all responsibility and/or liability arising from such Third Party Terms. You and the Third Party Service Providers are entirely responsible for communicating, agreeing to, and enforcing the Third Party Terms. You are solely responsible for reviewing such Third Party Terms before using or accessing any of the services provided by the Third Party Service Providers.
6.4 Price Fluctuations. Price fluctuations in digital assets should be expected. By using the Bybit Pay Services, you acknowledge and agree that you are willing and able to bear all risks caused by price fluctuations and any economic losses you may suffer.
6.5 Technical Anomalies. Technical anomalies may occur, which may delay or prevent you from using the Bybit Pay Services or performing related transactions and result in losses of your Digital Assets.
6.6 Market Anomalies. Market anomalies may occur, which may result in losses of your Digital Assets.
6.7 Changes to the Terms. To maintain an orderly market, we are required to add, remove, or change the policies, the terms of this Agreement, or other relevant service agreements or terms from time to time without notice to you. Any changes may benefit or harm individual customers like yourself.
6.8 Our Relationship with You. We are not your broker, dealer, intermediary, agent, or advisor. You acknowledge and agree that we do not have a fiduciary relationship with or fiduciary duty towards you in connection with any transactions, decisions, or other activities you undertake when using the Bybit Pay Services, and that you use the Bybit Pay Services at your own risk. We do not provide investment or financial advice of any kind, and no communication or information provided to you by us is intended as or should be construed as, advice of any kind. This Risk Disclosure section is not exhaustive and may not disclose all the risks associated with the Digital Assets and the use of the Bybit Pay Services. You should, therefore, carefully consider whether such use is suitable for you in light of your circumstances and financial resources, and seek professional advice regarding your particular situation before using the Bybit Pay Services. All transactions are executed based on the parameters of your order instructions. You alone are solely responsible for determining whether any investment, security or strategy, or any other product or service, is appropriate or suitable for you based on your investment objectives and personal and financial situation, and you alone shall be solely responsible for any Losses therefrom.
6.9 You shall be solely responsible, and you assume and shall bear all risk of Losses, for all conduct relating to the Bybit Pay Services or the use of the Bybit Pay Services, including but not limited to the risks mentioned herein. We expressly disclaim and do not take any responsibility for any losses, liability, or damage incurred as a result of your access to and use of the Bybit Pay Services.
7. Save as defined below, all terms and references used in this Agreement shall have the meaning given to them in the Service Agreement.
Beneficiary |
means the person who receives a transfer from a User through the Bybit Pay Services. |
Bybit Pay or Bybit Pay Services |
means the Bybit Pay service and any ancillary services made available by us, and includes the ability to transfer Digital Assets between Users and Merchants for the purchase of goods and/or services. |

means the Bybit Pay product page is available here, which may be updated and adjusted from time to time. |
Bybit QR Pay or QR Pay |
means a service that allows you to make payments to a Merchant for goods and services and/or to perform a transfer to a Beneficiary using a QR code generated by the Merchant/Beneficiary. |
Merchant |
means a registered Bybit Pay Services vendor or service provider that accepts Digital Assets via the Bybit Pay Services on its Merchant Sites for the purchase of goods and/or services. |
Merchant Site |
means the Merchant’s point(s) of sale where a sale occurs for the purchase of goods and/or services, and includes the Merchant’s physical stores, websites, and/or mobile applications. |
QR Codes |
means Quick Response Code, a type of matrix barcode (or two-dimensional barcode) that contains information about an item to which it is attached. |
QR Payments |
means payments made by a User by transferring monies into the Merchant’s/Beneficiary’s account using Bybit QR Pay. |
Settlement |
means when the transaction made by a User for the purchase of goods and/or services is complete and the Digital Assets used for the transaction are transferred or are to be transferred from the User’s Account to the Merchant’s Account. |
Settlement Funds |
means the Digital Assets used by a User to purchase goods and/or services from the Merchant. |
Supported Assets |
means those Digital Assets and/or fiat currency that are available in connection with your use of the Bybit Pay Services. |
8. Eligibility to Use the Bybit Pay Services
8.1 We reserve the right to determine, in our sole and absolute discretion, from time to time, the markets and jurisdictions in which to provide the Bybit Pay Services, and may restrict or refuse, in our sole and absolute discretion, at any time without notice, the provision of the Bybit Pay Services in certain countries or regions (including but not limited to situations where such restrictions are required to ensure compliance with applicable laws). Digital Assets cannot be used directly or indirectly for making payments in some regions. You are solely responsible for your transfer transactions and we are not liable for any losses you may incur.
8.2 You acknowledge and agree that to be eligible to use any functionalities of the Bybit Pay Services, you must meet the following conditions:
8.2.1 In order to be eligible to use the Bybit Pay Services you must create and maintain an Account as required under our Service Agreement and continue to meet all applicable requirements of maintaining such Account including without limitation providing your full legal name, country of residence, and other Know-Your-Customer (“KYC”) details that we may require from time to time.
8.2.2 You further acknowledge that:
8.2.2.1 there are legal and/or regulatory requirements in various jurisdictions, countries, or regions that may restrict the products and services that we can lawfully provide in connection with the Bybit Pay Services.
8.2.2.2 accordingly, the Bybit Pay Services may not be available or may be restricted in certain jurisdictions, countries, regions, or to certain users.
8.2.2.3 you shall be responsible for understanding and observing any restrictions and/or requirements imposed with respect to the access to and use of the Platform and the Bybit Pay Services in each jurisdiction from which the Platform and the Bybit Pay Services are accessed by you or on your behalf.
8.2.2.4 we reserve the right to change, modify, or impose additional restrictions with respect to the access to and use of the Platform and/or the Bybit Pay Services from time to time at our sole discretion without notice.
8.3 You understand and acknowledge that the availability of the Bybit Pay Services is subject to our satisfaction that you have met the eligibility criteria set out at this link, on the Bybit Pay Page, and in Section 8.2 above. If we determine at any time, at our sole discretion, that you do not meet or have ceased to meet any of the conditions set out at this link, on the Bybit Pay Page, and/or in Section 8.2 above, we may, at our discretion and without prior notice to you, suspend the provision of all or part of the Bybit Pay Services to you, close your Account, and/or restrict your access to the Bybit Pay Services.
8.4 You acknowledge and agree that:
8.4.1 we and/or our appointed processors/service providers shall be entitled to, and you shall cooperate with and assist us and/or our appointed processor/service providers to, undertake identification, credit, anti-money laundering, counter-terrorism financing, KYC, and other necessary checks and screenings required to comply with our internal compliance policies and applicable laws, at any time during your registration and use of service when our appointed processors/service providers or we deem necessary in our or their sole discretion.
8.4.2 all information you provide to us must be complete, accurate, and truthful at all times. You must update this information whenever it changes. We cannot be responsible for any financial loss arising out of your failure to do so. We and/or our service providers (if any) may also ask you at any time to confirm the accuracy of your information and/or provide additional supporting documents.
8.4.3 we may share such information with our service providers (if any), if our service providers require such information for legal and regulatory compliance purposes, or as part of service delivery to you.
8.5 Only certain Digital Assets can be used in conjunction with the Bybit Pay Services (including but not limited to funding your Account, as described below) and we reserve the sole discretion to determine which Digital Assets can be used in conjunction with the Bybit Pay Services.
8.6 You acknowledge, agree, and accept that we may, at any time, at our sole and absolute discretion, without liability or prior notice to you:
8.6.1 change the conditions for the use of the Bybit Pay Services;
8.6.2 suspend the provision of all or part of the Bybit Pay Services;
8.6.3 change, update, remove, cancel, suspend, disable, or discontinue any features, components, or content of the Bybit Pay Services; and/or
8.6.4 cancel, deny, or reject any request initiated by you in the Bybit Pay Services that are deemed in violation of the terms of this Agreement, the Service Agreement, or any other terms and conditions that may be applicable to you (including those imposed by Third Party Service Providers on you).
8.7 By continuing to use the Bybit Pay Services, you agree to be bound by the latest terms of this Agreement and other terms that apply to your activities in connection with the Bybit Pay Services.
8.8 You hereby declare that you use and access the Bybit Pay Services on your behalf only and that you are not acting on behalf or account of a third party.
9. Functionalities of Bybit Pay
9.1 The Bybit Pay Services permits you to:
9.1.1 fund your Account using Supported Assets;
9.1.2 transfer Digital Assets to and receive Digital Assets from another User of the Bybit Pay Services; and
9.1.3 transfer Supported Assets to and receive Supported Assets from a Merchant of the Bybit Pay Services.
9.2 To use the Bybit Pay Services, your Account needs to be funded with Supported Assets. You may choose to fund your Account by transferring Supported Assets from other third party wallets to your Account or any other methods permitted by us.
9.3 Sending Digital Assets to and Receiving Digital Assets from Other Users via the Bybit Pay Services.
9.3.1 You may send and/or receive Digital Assets using the Bybit Pay Services in accordance with the instructions published on the Platform from time to time.
9.3.2 We may, at our discretion and without prior notice:
9.3.2.1 impose limits on the amount of Digital Assets you can transfer, including the amount you send for purchases. You can view any sending limit under the “Pay Setting” under Bybit Pay; and/or
9.3.2.2 limit or otherwise restrict your ability to withdraw the Digital Assets received in your Account. This may include, without limitation, circumstances where processing your transfers may result in contravention of applicable laws, any transfers would cause you to exceed your applicable transaction and transfer limits, or we are unable to verify your identity or the source of funds, or for anti-money laundering (“AML”) or other compliance reasons.
9.3.3 You agree that you may send Digital Assets to other Users up to the transaction and transfer limits displayed in the “Pay Setting” under Bybit Pay.
9.4 Entering into Transactions with Merchants via the Bybit Pay Services.
9.4.1 You may make a purchase of goods or services from, or make other transactions with a third party Merchant using the Bybit Pay Services. This includes but is not limited to:
9.4.1.1 making a purchase at a Merchant Site (whether online or physical) and selecting Bybit Pay as your payment method at checkout;
9.4.1.2 making a payment to a third party Merchant for goods or services via scanning their respective QR code with Bybit Pay on mobile app; and
9.4.1.3 making a purchase from a third party Merchant, via the Bybit Pay Platform, whether through a link that directs you to the Merchant Site or otherwise.
9.4.2 Limits on Payment Methods.
9.4.2.1 Bybit Pay may limit the payment methods available for the transaction(s) you make with any of the Merchants, in order to manage risks.
9.4.2.2 Payment methods may also be limited for certain Merchants if you make a Bybit Pay payment through certain third-party websites or applications.
9.5 Conversion.
9.5.1 If your payment requires conversion by us, the transaction exchange rate will be based on the prevailing rate of exchange at the time the payment is processed.
9.5.2 You acknowledge and accept that:
9.5.2.1 The conversion of your Digital Assets to other Digital Assets or a Digital Asset to a fiat currency (or vice versa) may include a spread.
9.5.2.2 The conversion of your Digital Assets to a fiat currency (or vice versa) may involve certain Third Party Service Providers, and in this regard, you agree and accept that the conversion will be completed at the transaction exchange rate set by the Third Party Service Provider for the relevant currency exchange.
9.6 By using the Bybit Pay Services, you agree and accept that:
9.6.1 we may use all information, including personal information, the Merchant’s/Beneficiary information, and billing information, provided by you to us, or any information embedded in and/or transmitted via QR Code, in the course of using the Bybit Pay Services (“Payment Instructions”).
9.6.2 it is your sole responsibility to ensure that all your Payment Instructions are correct, complete, and accurate in every respect prior to confirming the QR Payment/transaction, and you understand that time is required to process your Payment Instructions.
9.6.3 all Payment Instructions, including the transaction amount entered by you or any information displayed or transmitted via the Merchant’s or the Beneficiary’s QR code shall be deemed by us to be correct upon your confirmation of the transaction. The Payment Instructions will be treated as final and we will not be required to verify the Payment Instructions with you. We are under no obligation whatsoever to verify that the amount paid or transferred matches the Merchant’s/Beneficiary’s amount.
9.6.4 we shall have no duty to and shall not be required to take any steps to verify or seek any other confirmation from any party as to whether such Merchant or Beneficiary is the intended party to receive the funds, or whether the amount paid or transferred matches the Merchant’s/Beneficiary’s amount. We shall not be liable for transferring the funds to such Merchant or Beneficiary even if such person is not the intended party.
9.6.5 Pursuant to Section 9.6.4, you agree that once a payment/transaction is confirmed, it will be deemed irrevocable, and you will not be able to cancel, stop, or perform any changes to that payment/transaction.
9.6.6 by providing us with your Payment Instructions, you agree to pay or allow us to deduct from your Account all fees and charges associated with your Payment Instructions.
9.6.7 no liability shall be incurred by us if we are unable to complete any transfers, payments, and/or transactions if any of the information provided in the Payment Instructions is or becomes incorrect.
9.7 Pay Limit. Transactions and transfers made using the Bybit Pay Services may be subject to limits, as determined by us from time to time at our discretion. Any transaction and transfer limits will be displayed in your Account in your ‘Bybit Pay’ settings. We reserve the right not to complete transactions where the transaction or transfer amount exceeds such limits or in other circumstances in our reasonable discretion, including where required by applicable legal and/or regulatory requirements. You should ensure that your limits are sufficient to cover the transactions or transfers you intend to make.
9.8 Disputes Handling.
9.8.1 We have no control over, or liability for, the delivery, quality, safety, legality, or any other aspect of any goods or services that you may purchase or sell from or to a third party. We are not responsible for ensuring that a third party you transact with will complete the transaction or is authorized to do so. Should there be any disputes (such as disputes over the amount paid due to errors or mistakes by either you, the Merchant, and/or the Beneficiary), the settlement of such disputes shall be between you and the Merchant / Beneficiary.
9.8.2 Please note that we will not revoke and/or reverse successful payments or transactions or play any part in the outcome or dispute settlement between you and the Merchant / Beneficiary.
9.8.3 We shall not be held responsible, amongst others, for disputes arising from:
9.8.3.1 you not receiving any goods or services from the Merchant;
9.8.3.2 the Merchant / Beneficiary not being contactable;
9.8.3.3 any wrongful or miscommunication by the Merchant / Beneficiary to you; or
9.8.3.4 any wrong/fraudulent/unauthorized payment.
9.9 Refunds.
9.9.1 You understand and agree that any complaints, claims, disputes, chargebacks, or refunds in relation to goods and/or services provided by and purchased from a Merchant will be resolved between such Merchant and yourself, and we will not be responsible for any refunds made or to be made by such Merchant.
9.9.2 In the event you are entitled to a refund for any reason when you make a purchase for goods and/or services using the Bybit Pay Services and a refund has been initiated by the relevant Merchant within 30 days from the date of purchase, the relevant Merchant will arrange for your Digital Assets to be refunded to your Account. The Bybit Pay Services will not be able to support refunds that are initiated by the Merchant more than 30 days after the date of purchase. Under such circumstances, you will need to arrange with the Merchant directly for an alternative method to receive your refund. The Bybit Pay Services will also not be able to support refunds if your transfer, payment, and/or transaction was made via Pix QR Pay. In such a case, you will need to arrange with the Merchant directly for an alternative method to receive your refund.
9.9.3 If a refund is initiated and posted by the Merchant, you understand and agree that the refund credited to your Account may not be denominated in the same Digital Assets originally used for the purchase, and we reserve the right to determine, at our discretion, the Digital Assets to be credited to your Account. In any event, the value of the Digital Assets credited to your Account will be equivalent to the value of your refund, subject to any applicable fees.
9.10 Unexecuted Transactions.
9.10.1 In the event that your authorization to send, receive, or pay using the Bybit Pay Services cannot be effected, completed, or processed due to system maintenance, failure or breakdown, non-availability of the Bybit Pay Services, whether or not originating from the User, Merchant, or us, no Digital Assets will be debited or otherwise deducted from your Account and the transaction will not be executed.
9.10.2 You acknowledge and agree that no liability shall be incurred by us if we are unable to complete any transfers, payments, and/or transactions for any reason beyond our control, including but not limited to:
9.10.2.1 if your Account does not contain sufficient funds or if the transfer would exceeds the transactional limit for your Account;
9.10.2.2 our payment processing system is not working properly and you know or have been advised by us about the malfunction before you execute the transfer, payment, and/or transaction;
9.10.2.3 you fail to provide us with the correct account information, or the information that you provided becomes incorrect; and/or
9.10.2.4 circumstances beyond our control (such as, but not limited to, fire, flood, or interference from an outside force), even if foreseeable or foreseen, which prevent the proper execution of the transfer, payment, and/or transaction, and we have taken reasonable precautions to avoid such circumstances.
9.11 Negative Balance.
9.11.1 You cannot cancel, reverse, or change any transfer, payment, and/or transaction marked as complete. In the event your Account falls into a negative balance for any reason whatsoever (including, but not limited to, when Settlements to Merchants are higher than the available balance in your Account), you understand and acknowledge that:
9.11.1.1 we reserve the right to:
9.11.1.1.1 reject the transfer, payment, and/or transaction;
9.11.1.1.2 deduct the negative amount from any associated accounts under your Account; and/or
9.11.1.1.3 take other necessary measures at our sole discretion to satisfy the negative balance and compensate for our Losses (if any);
9.11.1.2 your use of the Bybit Pay Services and/or other features or services provided by us may be suspended or restricted until the negative balance is satisfied and your Account is brought into good standing to our satisfaction; and
9.11.1.3 we reserve the right to take any and all action that we consider appropriate to recover our Losses to the maximum extent permitted by law.
9.12 Transaction Review.
9.12.1 To comply with our regulatory obligations, we may need to review certain transactions before allowing the transactions to proceed to execution. In such a situation, we will place a hold on the transaction and notify the relevant Merchant to hold or delay the shipment of the item or the provision of the services to you, as the case may be. Please note that this may delay your receipt of the item or service you have purchased. Once we have finished our review, we will notify the relevant Merchant and, if appropriate, direct them to proceed with the shipment of the item or the provision of services to you. We may at our reasonable discretion cancel the transaction and return the corresponding amount to your Account, or take any other action as permitted under any applicable law.
9.12.2 You acknowledge, agree, and accept that:
9.12.2.1 we have the right to suspend the processing of, refuse, or cancel any transaction at our sole discretion, the situation of which includes, but is not limited to, where we reasonably believe that the transaction may be unauthorized, fraudulent, illegal, abusive, involves any criminal activity, or where we reasonably believe you to be in breach of the Terms. We may also require additional verifications or information on any transaction.
9.12.2.2 you will cooperate in relation to any financial crime screening that is required and assist us in complying with any applicable laws or regulations.
9.12.2.3 you are liable to us for the full amount of the payment and/or transaction if such payment and/or transaction is later invalidated for any reason including, but not limited to, claims, chargebacks, or if there is a reversal of the payment/transaction.
9.12.2.4 you agree to allow us to determine at our sole discretion the appropriate party to incur the burden of such claims, chargebacks, or reversals and where applicable, to recover any amounts due to us by debiting your Account.
9.12.2.5 you will be responsible for all transactions made through the Platform via your designated Account, with or without your authority, knowledge, or consent, and may not claim against us in connection with any such use or purported use.
10. Fees
10.1 Certain fees may apply when you use the Bybit Pay Services and we reserve the right to adjust our pricing and fees at any time. The latest fee schedule can be found here (“Fee Schedule”). We may adjust our fees from time to time at our discretion without prior notice.
10.2 By accessing or using the Bybit Pay Services, you agree to pay all applicable fees, which may include, but are not limited to:
10.2.1 the fees imposed by the Merchants;
10.2.2 the spread which may be included in the conversion of a Digital Asset into another Digital Asset, or a Digital Asset into fiat currency (or vice versa);
10.2.3 any additional fees charged by and payable to the Third Party Service Providers or Governmental Authorities, including but not limited to network charges, taxes, and/or foreign exchange costs (which may be declared by such Third Party Service Providers or Governmental Authorities via separate legal documents and may be different when applied for users in selected territories and jurisdictions).
10.3 By authorizing a transaction using the Bybit Pay Services, you expressly authorize us to automatically deduct fees and any applicable third-party or compulsory charges directly from the funds available in your Account(s).
11. Third Party Service Providers
11.1 We may, at our discretion, rely on third party service providers (“Third Party Service Providers”) to provide regulated and unregulated financial or payment services, including exchange or conversion, settlement, and other services in connection with your use of the Bybit Pay Services (“Additional Services”).
11.2 In order to access or otherwise use the Additional Services, you may be required to agree to the other terms and conditions that are applicable to the Additional Services (including but not limited to any Third Party Terms), which may be updated by us or such Third Party Service Providers from time to time at our or their sole discretion. Terms and conditions for Additional Services will be brought to your knowledge when you use Additional Services.
11.3 You acknowledge and agree that:
11.3.1 we are not responsible or liable for any losses or damage of any sort that may arise directly or indirectly out of your use of the Additional Services. You understand and agree that your use of the Additional Services is at your own risk and you hereby accept all risk of Losses or damage that may arise directly or indirectly from using the Additional Services.
11.3.2 the Third Party Service Providers are entitled to, and you will cooperate with the Third Party Service Providers to, undertake identification, credit, anti-money laundering, counter-terrorism financing, KYC, and other necessary checks and screenings required to comply with our or their internal compliance policies and applicable laws, at any time during your registration and use of the Bybit Pay Services and the Additional Services when we or the Third Party Service Providers deem necessary in our or their sole discretion.
12. You hereby undertake to, wherever you are, use the Bybit Pay Services in compliance with all applicable laws. You further undertake to indemnify us from any and all liabilities that we may incur arising from your improper or non-compliant use of the Bybit Pay Services.
13. We disclaim to the maximum extent permitted by laws, and you hereby waive and release us from any and all claims, liabilities, causes of action, responsibilities, and Losses arising from or in any way related to, including but not limited to:
13.1 your use of the Bybit Pay Services; and
13.2 your use and access to the Platform.
14. We may be required under applicable laws and regulations to share information about your accounts and use of the Platform with third parties. You acknowledge, agree, and consent that we are entitled to disclose such information.
15. We reserve the right to, without prior notice:
15.1 temporarily or permanently prohibit you from accessing or using the Bybit Pay Services;
15.2 impose limits on your access or use of the Bybit Pay Services;
15.3 suspend or terminate the Bybit Pay Services; or
15.4 delay certain transactions in the Bybit Pay Services.
You understand and agree that we shall not, to the maximum extent permitted by law, be liable to you for any Losses caused by such prohibition, suspension, or termination.
16. You shall comply with all applicable laws and regulations and ensure and cease using the Bybit Pay Services where such compliance is no longer possible.
17. You agree and accept that we have the right to amend the content of this Agreement at any time in our sole discretion. We shall not be liable for any Losses due to your misunderstanding of this Agreement or your failure to take note of any amendments made to this Agreement from time to time.
18. The content contained in this website does not constitute an offer or sale of securities in or into the United States, or to or for the account or benefit of U.S. persons, or in any other jurisdictions where it is unlawful to do so. Transfer of Digital Assets may be subject to legal restrictions under applicable laws. Under no circumstances shall the Digital Assets be reoffered, resold, or transferred within the United States or to, or for the account or benefit of, U.S. persons, except pursuant to an exemption from, or in a transaction not subject to, the registration requirements of the U.S. Securities Act of 1933, as amended. Any public offering of the Digital Assets to be made in the United States will be made by means of a prospectus that may be obtained from the issuer or the selling Digital Asset holder and that will contain detailed information about the company and management, as well as financial statements.
